The purpose of this letter is to advise the U.S. Department of Agriculture (USDA) of meat labeling regulations that were recently finalized in Mississippi and to request a determination from the highest levels of the Department that the Mississippi statute and regulations are preempted by federal law, including the Federal Meat Inspection Act (FMIA) and the recently amended Agricultural Marketing Act (AMA), and are, therefore, unlawful. We urge USDA to act expeditiously to protect the clear scope of the Agency’s jurisdiction over meat labeling and to prevent Mississippi from enforcing an unlawful and unconstitutional law.
