Overview of Proposition 65 Regulations

FMI will be hosting a webinar to discuss California’s Proposition 65 and recent changes that will go into effect in 2018. Proposition 65 (Cal. Health & Safety Code § 25249.5) is a California initiative passed by voters in 1986 and states that “[n]o person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the state to cause cancer or reproductive toxicity without first giving clear and reasonable warning to such individual…” The law is a “right-to-know” warning statute requiring businesses to provide warnings when their products expose consumers to certain listed carcinogens and reproductive toxicants. There are currently over 800 listed carcinogens and reproductive toxicants under the law.

The law firm of Downey Brand LLP will be assisting with the webinar and will be available to answer any questions you members may have. They will provide a brief primer on the new Proposition 65 warning regulations that go into effect less than a year from now as well as highlight those portions of the regulations that are most important to FMI’s members. In addition, they will discuss some ways FMI members can manage their Proposition 65 risk under the new regulations.
